Terms and Conditions

Code of Conduct

Professional exchanges between any two parties must necessarily be governed by terms and conditions. These Terms & Conditions have been prepared in clear, straightforward language to guide and protect both the client (hereinafter referred to as The Client) and Roger E Nixon and/or any researcher retained by him in connection with search/research of a client's requirements (hereinafter referred to as The Researchers)

BASIC OBLIGATIONS of The Researchers are to

  • always respond promptly to any enquiries
  • establish clear objectives of an enquirer
  • provide an appraisal of what might or might not be achievable
  • indicate a financial budget likely to apply together with payment terms
  • undertake search/research in accordance the established objectives
  • provide written/email/fax details of findings and of records consulted
  • submit a clear statement of final fees and costs applicable upon completion of work

BASIC OBLIGATIONS of The Client are to

  • submit all details with any known references of a subject to be researched
  • submit written/email/fax agreement to proceed with a commission
  • provide precise name and full private postal address with a telephone/fax no for backup
  • answer promptly questions that may require answers during a commission
  • refer back any queries concerning the commission within five days
  • remit all costs and charges due in accordance with the agreed quotation

Other

The service provided is to search/research various types of records and wherever possible to supply historical information or to search and copy such material. No guarantee is made or implied that these may be locatable although every endeavour will be made to indicate what might be obtainable when supplying an appraisal and budget costing and will take all reasonable professional care to find information within the bounds of what is reasonable in terms of time spent and sources consulted. Where searches prove unsuccessful or partially successful, no guarantee can be made that further relevant material exists or does not exist.

All quotations offered for service are in Pounds Sterling (GBP) unless otherwise indicated. Payment may be made by Sterling cheques or drafts payable at London, England. Where equivalent amounts in other foreign currency denominations are due then these will be at the rate of exchange applicable on the day instructions are received to a commission is granted. Remittances made by credit card or by foreign cheque may incur a handling charge at a rate which will be given in any quotation. Where international transfers are made through intermediaries (such as PayPal, Nochex etc) then invoices for service will always be payable in Pounds Sterling and include such handling charges as may be incurred by such providers. Payment terms will be stipulated in any quotation. The costs of photocopies, facsimiles, digital images, certificates, certification and/or legalization, travel/fares, adequate post & packing and insurance are always payable in addition to search/research service charges. All material will be forwarded at clients' risk. Search/research service charges may be based on an hourly rate or for a fixed amount: Each enquiry will be quoted individually. Details of the client's name and address and commission details may be held in a manual or electronic form in accordance with the provisions of the current United Kingdom Data Protection Act. The researchers reserves the right to pursue non-payment of fees and costs through judicial or other channels which may mean disclosure of facts to third parties.

All written or intellectual material prepared and supplied by the Researchers will be subject to copyright. The National Archives (including Public Record Office), Kew, UK, records including maps, drawings or photographs are generally subject to Crown Copyright and material held by other UK places of deposit may also be subject to varying forms of copyright and none these may be reproduced without prior permission or the payment of any fees relevant thereto. Whilst every effort will be made to obtain quality reproductions in the form of photocopies, facsimiles, drawings, electronic scans or photographs, the quality guarantee is that they shall be sufficient only for research purposes. Service conditions of supplying repositories will apply in all cases.

In the event of dispute between the Researchers and the Client, the client must firstly set out in writing a full explanation and post the same by registered letter to The Researchers who will then respond within 14 days with an explanation. In the event that a dispute shall remain unresolved between The Researchers and The Client, then copies of the claim, the response and the working file notes will be passed to an independent UK adjudicator experienced in dealing with historical research and record searching matters in the United Kingdom. The decision of the independent adjudicator will be final. Court England.
